Acceptance of the Terms of Use
These terms of use are entered into by and between you and Express Apostille Services, LLC (“Company”, “we”, or “us”). The following terms and conditions (“Terms of Use”) govern your access to and use of our services, including our notarization, apostille, and other related services, any content, functionality, and services offered by us.
Please read the Terms of Use carefully before you submit any documents. By clicking to accept or agree to the Terms of Use or by submitting any document to us, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at https://expressapostilleservices.com/privacy-policy/ incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you should not submit any documents or engage us for any services.
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of our services or this website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page, so you are aware of any changes, as they are binding on you.
The Services We Offer
We provide notarization, apostille facilitation, and document processing services only. Our services are strictly limited to:
- Receiving documents uploaded or otherwise provided by you.
- Creating and/or attaching a custodial or copy certification attesting that the copy we process is an exact copy of the document received by us.
- Notarizing the custodial or copy certification, where applicable.
- Submitting documents to the appropriate government authority (such as a Secretary of State) for issuance of an apostille.
- Returning the documents to you by mail or courier, domestically or internationally.
What We Do NOT Do
We do not:
- Verify the authenticity, validity, legality, accuracy, truthfulness, or completeness of any document submitted.
- Determine whether a document is real, fake, fraudulent, forged, or legally enforceable.
- Investigate the source, origin, or prior use of any document.
- Provide legal advice, immigration advice, academic credential evaluation, or government certification.
- Issue apostilles ourselves. We provide a custodial certificate to the appropriate government authority to issue a valid apostille on your behalf.
- Guarantee acceptance of any apostilled document by any foreign or domestic authority.
- Confirm whether a document may lawfully be used for any specific purpose.
An apostille only certifies the authenticity of a government official’s signature or seal. It does not authenticate, validate, approve, or endorse the underlying document or its contents.
Information Provided by You
You acknowledge and agree that all information, documents, or materials you submit through the website, email, or any other means, including personal information, copies of documents, and supporting materials (collectively, “Material”), are submitted at your own risk. You represent and warrant that all Material is true, accurate, complete, and not misleading to the best of your knowledge. You further acknowledge that we rely entirely on the Material to provide the services and that we do not independently verify the authenticity, accuracy, or legality of such Material. We are not responsible for any errors, omissions, or consequences arising from the submission of incorrect or incomplete information. You agree to indemnify and hold harmless the Company, its officers, employees, agents, and notaries from any claims, losses, damages, or liabilities (including without limitation attorneys’ fees and cost) arising from or related to the Material, including any use of such information by third parties or government authorities.
Customer Representations
You may use the website and our services only for lawful purposes and in accordance with these Terms of Use. By submitting documentation and using our services, you represent and agree that:
- You have the legal right, authority, and permission to submit the documents and you are submitting documents in good faith.
- The documents provided are true copies, not altered, modified, or counterfeit, and are not submitted for any illegal, fraudulent, deceptive, or unlawful purpose.
- You will not use our services to facilitate fraud, misrepresentation, identity theft, immigration fraud, academic fraud, or any unlawful activity.
- You accept full responsibility for the use, misuse, or consequences of the documents submitted.
No Guarantee of Acceptance
While we submit the documents provided by you to the appropriate government authorities for apostille issuance, we do not and cannot guarantee that any government authority, foreign or domestic, will accept, approve, or honor the final deliverable. You acknowledge and agree that acceptance of apostilled documents is entirely at the discretion of the receiving authorities, and we have no influence or control over such acceptance. The services provided are limited to the submission and retrieval of apostilled documents as received from the government authorities, and any rejection, delay, or refusal by the receiving authority is not the responsibility of us. You assume all risks associated with the acceptance or non-acceptance of apostilled documents, including any consequences that may arise in connection with employment, immigration, education, or other legal or administrative matters.
Fees and Refund
If something goes wrong, we will do our best to make it right. If a resolution cannot be reached, we will refund our service fees; some transaction fees may apply. If the order has been fulfilled, a portion of our service fee and/or shipping fees can be refunded if you are not satisfied. Please note: While we may work with you to resolve issues to ensure customer satisfaction. We are not responsible if the documents are lost, destroyed or damaged during courier transit periods shipped via USPS, FEDEX, UPS, DHL or any other courier, and request of refund due to any lost, destroyed or damaged documents will not be accepted.
Shipping and Risk of Loss
All documents, whether original or copy, submitted to or returned by us are shipped at the customer’s risk. Upon transfer of documents to any courier, postal service, or shipping provider, including international shipments, we will not be liable for loss, theft, damage, mis-delivery, or delay. You should ensure proper insurance, tracking, and packaging of their documents for transit. You will receive a tracking number once your document is shipped. Any claims for loss or damage in transit must be directed to the carrier or shipping service used. Our responsibility is strictly limited to the handling, submission, and return of documents in accordance with the services, and the risk of loss during transportation rests entirely with you.
Disclosure and Cooperation
We reserve the right to disclose any documents, files, information, or related data submitted by you if it reasonably believes such disclosure is necessary to comply with applicable laws, regulations, subpoenas, court orders, or requests from governmental authorities. We may also disclose information to protect our legal rights, prevent fraud, detect unauthorized use of the services, or investigate suspected illegal or fraudulent activity. Additionally, we will cooperate fully with law enforcement agencies, regulatory authorities, or other legal entities as required. Such disclosures or cooperation do not constitute a waiver of any rights or obligations under these Terms of Use, and we shall not be liable for any consequences arising from such disclosures, including but not limited to actions taken by third parties, government authorities, or other recipients of the disclosed information.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. THE COMPANY DOES NOT GUARANTEE THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DOCUMENTS WILL BE ACCEPTED BY GOVERNMENT OR FOREIGN AUTHORITIES. ANY INFORMATION, ADVICE, OR GUIDANCE PROVIDED THROUGH THIS WEBSITE OR SERVICES IS FOR GENERAL INFORMATION PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE. BY USING THE SERVICES, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, EMPLOYEES, AGENTS, AND NOTARIES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, OR DAMAGE TO REPUTATION, ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE THE SERVICES, SUBMISSION OF DOCUMENTS, OR ACCEPTANCE OF APOSTILLED DOCUMENTS BY ANY THIRD PARTY OR GOVERNMENT AUTHORITY. THE COMPANY’S TOTAL AGGREGATE LIABILITY, WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU FOR THE SPECIFIC SERVICE THAT IS THE SUBJECT OF THE CLAIM. YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY REFLECTS A REASONABLE ALLOCATION OF RISK AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND THE COMPANY.
Governing Law and Jurisdiction
All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Illinois, United States of America without giving effect to any choice or conflict of law provision or rule.
Arbitration
At Company’s sole discretion, it may require you to submit any disputes arising from the services provided, these Terms of Use, or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Illinois law.
Use of Third Parties Service Providers
We may engage third-party service providers or contractors to facilitate the services. By using our services, you acknowledge and agree that we are not liable for the acts, errors, omissions, or negligence of any third-party service provider. Any use of such third-party services is solely for the purpose of assisting us in delivering the services, and all obligations and disclaimers in these Terms of Use apply to services provided by third parties on our behalf.
